Pappas Grubbs Price Associate Sam Perez recently secured a dismissal of all claims against a client by arguing a Motion to Strike Plaintiff’s Amended Petition filed outside of the Court’s ordered Joinder Deadline.
The Case involved a plaintiff who claimed severe injuries while a shipment was being unloaded. The plaintiff amended their petition on the eve of limitations to add our client as an additional defendant. However, this was done after the Court’s joinder deadline and without the plaintiff seeking leave from the court to join an additional party to the lawsuit. Mr. Perez successfully argued that the plaintiff’s amended pleading should be stricken from the record and the client dismissed with prejudice because the statute of limitations had passed.
