Plaintiff injured himself while working for our client and subsequently collected substantial benefits under our client’s workers’ compensation policy. Despite Texas law stating that these benefits were Plaintiff’s exclusive remedy for his on-the-job injury, Plaintiff sued our client for damages under several theories of recovery. We moved for summary judgment on all such claims, in response to which Plaintiff argued that he was entitled to circumvent legal authority barring his suit against our client. However, the Court agreed that our client was entitled to summary judgment as a matter of law. The Firm is always pleased to secure such victories on behalf of our clients.
