Insurance Defense Litigation

Adam has represented hundreds and hundreds of insureds while handling a wide variety of cases for insurance clients, including premises liability cases, automobile accident cases, products liability cases, defamation and disparagement cases, and copyright and trademark infringement cases. Some examples of these cases are:

  • Tried to a defense verdict a serious personal injury case involving snowmobiles and recreational use of snowmobiles in Buffalo, New York
  • Tried to a defense verdict a wrongful death and personal injury case involving a motorcycle rider and passenger in Montgomery County, Texas
  • Successfully represented a prominent Rio Grande Valley physician against claims of defamation and business disparagement
  • Tried to a defense verdict a premises liability claim against a major Houston-area shopping mall

Construction Defect Litigation

Adam has handled a wide variety of construction defect claims on behalf of clients, including cases involving residential, commercial, entertainment and industrial facilities. Some examples are:

  • Securing a Summary Judgment in favor of an EIFS installer against an EIFS manufacturer
  • Trying to defense verdict a case involving the lights on top of the Toyota Center
  • Trying to a defense verdict a case involving claims by an independent living facility developer against an HVAC contractor.
  • Defending an Austin-area luxury residential developer against claims by a celebrity owner in excess of $27 million.
  • Has represented clients throughout Texas for breach of contract, delay claims, construction defect, and professional errors and omissions claims in residential, commercial, and industrial construction projects.
  • Represented a designer/general contractor at trial in a high-profile construction defect case in Austin.
  • Has represented numerous general contractors in disputes in litigated and arbitrated matters with Homeowners Associations and homeowners, involving every construction trade. I have represented virtually every construction trade in litigation.
  • Represented a local concrete batch plant operator at a trial involving alleged construction defects, violations of the Texas Deceptive Trade Practices Act and fraud.

Trucking Accident Litigation

Adam has represented dozens of trucking and transport companies and independent owner-operators against claims brought by personal injury Plaintiffs, including personal injury claims throughout the State of Texas.

Copyright and Trademark Litigation

Adam has represented businesses alleged to have copied trademarks, tradenames and other copyrights of dozens of businesses, including a commercial landlord, a musical production company, a specialty candy manufacturer and a natural gas equipment manufacturing company. Some examples are:

  • Tried to a defense verdict claims of copyright and tradename infringement by an oilfield services company against a manufacturer of natural gas equipment.

Commercial Litigation

Adam has represented a number of businesses in a wide range of disputes, including alleged breaches of contract, breaches of fiduciary duties, asbestos exposure, and violations of CERCLA and the TSWDA. Some examples are:

  • Represented a local retail electric provider in various claims by former managers, employees and officers
  • Represented a tube manufacturer in cases of alleged asbestos exposure of prior employees, and in a case involving alleged environmental contamination.
  • Has represented numerous Houston-area businesses in litigated disputes amongst shareholders and limited liability company managers regarding the treatment and value of ownership interests.
  • Represented numerous businesses in disputes between businesses, including representing businesses seeking to recover funds from clients.

Appellate

Briefed and argued appeals related to Chapter 82 of the Texas Civil Practice and Remedies Code’s provisions on products liability indemnity.

Arbitration and Mediation

I represented a trucking company and commercial driver in a serious personal injury matter occurring in East Texas that was submitted to binding arbitration. I routinely handle construction defect cases involving residential and commercial structures in arbitration, including homes and subdivisions throughout the State of Texas. I represented general contractors, design professionals, and subcontractors in arbitrations involving dozens of structures and approximately one hundred homes.

Environmental and Toxic Tort

Has represented a corporate client in various RCLA and TSWDA claims in the Houston metropolitan area related to alleged ongoing and threatened emissions.

Products Liability

  • Represented a manufacturer of commercial LED lights at trial against a Houston-area stadium owner alleging defective products and extensive property damages and economic injuries.
  • Prosecuted product defect claims against an EIFS manufacturer by an EIFS installer related to homes in Houston and the Woodlands.
